Please Sign This Liability Waiver Form

IN CONSIDERATION of being permitted to observe or participate in the sessions, classes, guided workouts, fitness trainings, tournaments, or any other gym activities (hereinafter “Events”) and/or being permitted to enter any area where access to the general public is prohibited (hereinafter “Restricted Area”), the participant, or the participant’s parent or legal guardian if the participant is under the age of 18 (both hereinafter referred to as “Participant”), agree as follows:

1. PARTICIPANT INSPECTION

Participant shall inspect the facilities and equipment to be used, and if Participant believes anything is unsafe, will immediately advise the staff of such condition and refuse to participate. Participant agrees to be fully responsible for his or her own safety while on the premises. Participant shall avoid all areas of the premises he/she feels to be unsafe and shall refuse to participate in all activities he/she feels to be unsafe.

2. ASSUMPTION OF RISK

I, the undersigned Participant, understand and acknowledge that participation in any Events at Anthem Martial Arts LLC (“Anthem”) involves physical exertion and inherent risks, including but not limited to:

Strains, sprains, bruises, and other minor injuries

More serious injuries such as fractures, dislocations, or concussions

Risks associated with physical contact, grappling, striking, and partner drills

Risks associated with equipment use and facility conditions

Participant fully understands and acknowledges that:

There are risks and dangers associated with observing or participating in Brazilian Jiu-Jitsu and Tang Soo Do which could result in property damage, bodily injury, partial and/or total disability, paralysis, or death.

The social and economic losses and/or damage which could result from these risks and dangers as described above could be severe.

These risks and dangers may be caused by the action, inaction, or negligence of the Participant or the action, inaction, or negligence of others, including, but not limited to, the Releasees named in Section 4 below.

There may be other risks not presently known or which are not reasonably foreseeable at this time.

Participant accepts and assumes such risk and responsibility for the losses and/or damages flowing from any such injury, disability, paralysis, or death, however caused and whether caused in whole or in part by the negligence of the Releasees named in Section 4 below.

3. ACKNOWLEDGEMENT OF DANGER

Participant hereby acknowledges the activities of the Events are inherently dangerous and involve the risk of Participant receiving any of the harms described above, and that in the event of those harms, any injury may be compounded or increased by negligent rescue operations or procedures of the Releasees.

4. RELEASE OF LIABILITY

In consideration for being permitted to participate in Events and activities at Anthem, Participant DOES HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Anthem Martial Arts, LLC, its members, managers, promoters, employees, contractors, line coaches, instructors, facility and property owner(s), its members, shareholders, officers, agents, servants, representatives, or families (hereinafter “Releasees”), from all liability to the undersigned, including the representatives, assigns, executors, heirs, and next of kin of the undersigned, for any and all claims, demands, losses, or damages resulting from any injury, including but not limited to death of the Participant or damage to property, arising out of or relating to any incident caused by or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

5. INDEMNIFICATION

Participant hereby expressly further agrees to indemnify, hold harmless, and defend Releasees from and against any and all claims (including claims for property damage, personal injury, or death), demands, actions, or causes of action (including attorney’s fees and costs) that are herewith brought by anyone arising out of or in connection with his/her presence in the Restricted Area or while participating in the Events.

6. SCOPE OF WAIVER

Participant further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Georgia and that if any portion is held invalid, such decision shall not affect the validity of any remaining portion, which shall remain in force and effect.

7. MEDICAL AUTHORIZATION

I certify that I am physically capable of participating in martial arts training. I agree to notify Anthem of any medical conditions that may affect my ability to train safely.

In the event of an emergency, I authorize Anthem staff to obtain medical treatment for me and agree to be financially responsible for any associated costs.

8. PHOTO & VIDEO RELEASE

I grant Anthem Martial Arts LLC permission to photograph me, record video of me, and use my image, likeness, voice, or appearance for promotional, educational, or marketing purposes, including but not limited to:

Social media

Website content

Printed materials

Advertising

Digital media

I understand that:

I will not receive compensation for the use of these materials.

Anthem owns all rights to the photos and videos taken.

This release is perpetual unless revoked in writing.

If I wish to opt out of photo/video use, I must notify Anthem in writing. Anthem will make reasonable efforts to honor such requests for future content.

9. MINOR PARTICIPANTS (IF APPLICABLE)

If the participant is under 18 years old, a parent or legal guardian must sign below. The parent/guardian agrees to all terms of this waiver on behalf of the minor.

10. ACKNOWLEDGMENT & SIGNATURE

By signing below, I acknowledge that:

I have read and fully understand this Liability Waiver & Photo/Video Release;

I freely and voluntarily agree to all terms without inducement, assurance, or guarantee;

I understand that this document affects my legal rights;

I intend my signature below to be a complete and unconditional release of all liability to the greatest extent allowed by law.
